General Terms and Conditions of Martin Damrath
§ 1 Scope and Definitions
The following General Terms and Conditions apply to all deliveries between us and consumers in the version valid at the time of the order.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed professional activity (§ 13 German Civil Code – BGB).
§ 2 Conclusion of Contract and Storage of Contract Text

The presentation of goods in our online shop does not constitute a legally binding offer on our part, but rather a non-binding invitation to the customer to place an order. By ordering the desired goods, the customer submits a binding offer to conclude a purchase contract.
Upon receipt of an order in our online shop, the following procedure applies: The customer submits a binding contractual offer by successfully completing the ordering process provided in our online shop.
The order process consists of the following steps:
- Selecting the desired goods
- Confirming the selection by clicking the “Buy” button
- Reviewing the shopping cart
- Clicking the “Checkout” button
- Logging into the online shop after registration and entering login details (email address and password)
- Reviewing and correcting the entered data if necessary
- Submitting the binding order by clicking the “Place order” or “Buy” button
Before submitting the binding order, the customer may use the “Back” function of their browser to return to the previous pages and correct any input errors or cancel the ordering process by closing the browser window.
We confirm receipt of the order immediately by means of an automatically generated email (“Order Confirmation”). This confirmation constitutes acceptance of the offer.

Previous orders can be viewed in your customer account.
§ 3 Prices, Shipping Costs, Payment and Due Date
All stated prices include statutory VAT and other price components. Additional shipping costs may apply.
Customers may choose from the following payment methods: advance payment, direct debit, PayPal or credit card (American Express, Mastercard, Visa).
If advance payment has been selected, payment is due immediately after conclusion of the contract.
§ 4 Delivery
Unless otherwise clearly stated in the product description, all items offered by us are ready for immediate dispatch. Delivery will take place within a maximum of 5 working days within Germany and 14 working days for international shipments.
In the case of advance payment by bank transfer, the delivery period begins on the day following the payment instruction to the bank. For all other payment methods, the delivery period begins on the day following the conclusion of the contract. If the final day of the delivery period falls on a Saturday, Sunday or public holiday at the place of delivery, the period ends on the next working day.
The risk of accidental loss or accidental deterioration of the goods passes to the buyer only upon delivery of the goods to the buyer, including in the case of shipment purchases.
If a shipment cannot be delivered due to incorrect or incomplete address details, or if it is not collected within the designated holding period from a post office, parcel locker or another collection point, the customer shall bear the resulting return shipping costs, provided that the customer is responsible for the failed delivery.
The flat-rate return shipping charges are €6.49 within Germany, €10.00 within the EU and €20.00 outside the EU. The customer is expressly entitled to demonstrate that no damage or significantly lower damage has been incurred by us.
The same applies if the customer refuses to accept the shipment without a valid reason. Refusing delivery alone does not constitute a valid declaration of withdrawal from the contract.
Once an undeliverable or uncollected shipment has been returned to us, it will not be automatically reshipped. We reserve the right to reverse the purchase contract in accordance with applicable legal provisions. In the event of a reversal, the purchase amount will be refunded, taking into account any legitimate counterclaims. If the customer still wishes to receive the goods, a new order may be placed. The customer's statutory rights remain unaffected.
§ 5 Retention of Title
We retain ownership of the goods until full payment of the purchase price has been received.
§ 6 Warranty
The statutory warranty regulations shall apply.
§ 7 Contract Language
The contract language shall be exclusively German.
