General Terms and Conditions of Martin Damrath
§ 1 Scope and Definitions
The following General Terms and Conditions apply to all deliveries between us and consumers in the version valid at the time of the order.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed professional activity (§ 13 German Civil Code – BGB).
§ 2 Conclusion of Contract and Storage of Contract Text
The following provisions regarding the conclusion of contracts apply to orders placed via our online shop: https://www.mediarath.de

The presentation of goods in our online shop does not constitute a legally binding offer on our part, but rather a non-binding invitation to the customer to place an order. By ordering the desired goods, the customer submits a binding offer to conclude a purchase contract.
Upon receipt of an order in our online shop, the following procedure applies: The customer submits a binding contractual offer by successfully completing the ordering process provided in our online shop.
The order process consists of the following steps:
- Selecting the desired goods
- Confirming the selection by clicking the “Buy” button
- Reviewing the shopping cart
- Clicking the “Checkout” button
- Logging into the online shop after registration and entering login details (email address and password)
- Reviewing and correcting the entered data if necessary
- Submitting the binding order by clicking the “Place order” or “Buy” button
Before submitting the binding order, the customer may use the “Back” function of their browser to return to the previous pages and correct any input errors or cancel the ordering process by closing the browser window.
We confirm receipt of the order immediately by means of an automatically generated email (“Order Confirmation”). This confirmation constitutes acceptance of the offer.
We store the contract text and send the order details together with these Terms and Conditions by email. The Terms and Conditions can also be viewed at any time at: https://www.mediarath.de/policies/terms-of-service/
Previous orders can be viewed in your customer account.
§ 3 Prices, Shipping Costs, Payment and Due Date
All stated prices include statutory VAT and other price components. Additional shipping costs may apply.
Customers may choose from the following payment methods: advance payment, direct debit, PayPal or credit card (American Express, Mastercard, Visa).
If advance payment has been selected, payment is due immediately after conclusion of the contract.
§ 4 Delivery
Unless otherwise stated in the product description, all items are ready for immediate dispatch. Delivery takes place within up to 5 working days within Germany and up to 14 working days for international shipments.
In the case of advance payment, the delivery period begins on the day after the payment order is issued to the transferring bank. For all other payment methods, the delivery period begins on the day after conclusion of the contract.
If the final day of the delivery period falls on a Saturday, Sunday or public holiday at the place of delivery, the period shall end on the next working day.
The risk of accidental loss or deterioration of the goods passes to the customer only upon delivery of the goods to the customer, including in the case of shipment purchases.
If a shipment cannot be delivered due to incorrect address details provided during the order process, or if a shipment delivered to a DHL Packstation or DHL branch is not collected and is returned to us after the storage period has expired, the customer shall bear the resulting return shipping costs charged by DHL.
These costs amount to €6.49 within Germany, €10.00 within the EU and €20.00 outside the EU. In the event of re-shipment, the regular shipping costs will apply additionally.
If acceptance of the ordered goods is refused, the customer shall also bear the resulting return shipping costs charged by DHL. Refusing acceptance alone does not constitute a valid withdrawal from the contract.
§ 5 Retention of Title
We retain ownership of the goods until full payment of the purchase price has been received.
§ 6 Warranty
The statutory warranty regulations shall apply.
§ 7 Contract Language
The contract language shall be exclusively German.
